In 2012, Mackenzie Smith was instructed to market approximately nine acres of undeveloped land within Surrey Heath on a subject to planning basis. This case is a prime example of how land transactions differ from traditional property transactions, in that the complete project required four to five years of detailed work to see the project through to completion.
Following initial instructions from our clients, we secured a number of bids. Taking advantage of our connections with both experienced and reliable developers, we were able to support and advise the owner as to the best sale method, agreeing terms with the developer on a subject to planning basis. This involved working closely with our clients and their lawyers.
The planning process was not straightforward, with the original planning application being refused following multiple objections from local residents. Despite this, we and the developers felt that the land was suitable for redevelopment. The Developer then appealed this decision and the Planning Inspectorate granted the planning permission following a public enquiry. Throughout the planning and appeal process we assisted the developer with surveys, reports, property advice as well in many instances, physically driving legal documents requiring signatures from one place to another in order to meet the necessary deadlines.
With years of dedication and persistence from our Land Department and other professionals involved, a successful result was secured for our clients.
